The Studio is a platform on Latin Dance Events, LLC that empowers anyone to create and share educational content on Latin Dance or Music. We do review each course before publishing, however, we do not edit these courses and cannot assess their legal compliance, we are committed to respecting intellectual property rights and expect our instructors to do the same. By sharing content on The Studio, instructors confirm they have the appropriate permissions or rights to use the material they upload.

Latin Dance Events does not tolerate any infringing activities.

This policy outlines our actions regarding copyright takedown notices from content owners and trademark takedown notices from trademark holders concerning content on The Studio. It also covers our response when The Studio instructors’ courses are reproduced on third-party platforms without their permission.

Copyright Takedown Notices

Latin Dance Events maintains a policy to remove content from our platform when we receive a copyright takedown notice from the original content owner. Furthermore, if an instructor is identified as a repeat infringer (with more than two valid copyright takedown notices filed against them), we will remove all of their content. We also reserve the right to terminate an instructor's account at any time, especially if they share content that infringes on others' copyrights.

How to File a Copyright Takedown Notice

If you are the owner or authorized agent of the rights holder and would like to report content on The Studio that you believe is infringing, the most efficient way to do so is by using our copyright complaint form. Alternatively, you may submit notices of alleged copyright infringement through the contact information listed below. Also, please note that a copy of your notice will be provided to the instructor of the content in question.

Please consider these key points before submitting a copyright takedown notice:

  1. Knowingly submitting a false or misleading copyright takedown notice is against the law and may lead to liability for damages. Latin Dance Events reserves the right to seek compensation from anyone who files an infringement claim unlawfully.
  2. Evaluate whether the use of your material might qualify as “fair use.” Copyright law provides a “fair use” exception for certain uses of copyrighted content that benefit the public interest. Before submitting a copyright claim, ensure that the copied content doesn’t fall under this exception. Fair use often applies to purposes like criticism, commentary, news reporting, and research. To determine if the use of your material may be considered fair use, take into account the following factors:
    • The nature of the copyrighted material (for instance, whether your work is informational or creative)
    • The extent of the material used (such as whether only small, necessary excerpts are included or significant portions of your work are used)
    • The purpose of the use (for example, whether the content is monetized or free, or if it involves critique, parody, or transformation of your material)
    • The impact on the demand for your material (for instance, whether potential buyers might choose the content over purchasing your original work)
  3. Certain content types do not fall under copyright protection. Short phrases are not protected by copyright laws because hey are regarded as common expressions in the English language and are available for anyone to use freely (such as slogans, titles, systems or even business names), factual information or abstract ideas (like methods, processes, or recipes). Before submitting a copyright claim, please verify that the copied content qualifies for copyright protection. For trademark violations, follow the instructions in the How to Submit a Trademark Takedown Notice section below.
  4. We can only process a copyright claim when it is submitted by the copyright owner or their designated representative, as we cannot verify whether the instructor has obtained permission from the owner to use the content. To confirm your authority, we will request an electronic signature, verifying that you are either the copyright owner or authorized to act on their behalf (including on behalf of an organization). If you’re not the copyright owner, you may share Latin Dance Events' copyright complaint form with them directly.
  5. For us to address your copyright claim, it must be thoroughly supported. This means:
    • Clearly identify the original copyrighted material, or if your notice covers multiple works, provide a representative list of the original materials (such as a URL where each item can be found);
    • Provide enough details to help us locate the allegedly infringing content on The Studio, including the URL on our site, along with the exact course name and instructor's name;
    • Provide adequate contact information, including your full legal name, email address, physical address, and a phone number;
    • If submitting a notice for an organization, please provide the organization’s name and specify your role or affiliation with it; and
    • Include statements saying: 
      • “I hereby declare, under penalty of perjury, that I am the copyright owner or am authorized to act on the copyright owner's behalf and that the information in this complaint is accurate."
      • "I hereby declare that I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law”.

Trademark Takedown Notices

Latin Dance Events, LLC has a policy to remove content from The Studio if it is reported and determined to infringe on a third-party trademark. If you are a trademark owner or an authorized representative, you may submit a trademark takedown notice to Latin Dance Events. We reserve the right to terminate an instructor’s account at any time, particularly if they post content on The Studio that infringes on another’s trademark rights.

How to File a Trademark Takedown Notice

The quickest and simplest way to file a trademark takedown notice with us is by using this trademark complaint form. Please note that a copy of your notice will be provided to the instructor of the content in question.

Before submitting a trademark takedown notice, keep the following key points in mind:

  1. Consider whether the use of your trademark qualifies as “fair use.” Trademark law protects names or brands in the sale of goods and services to prevent consumer confusion. Many countries’ laws include a “fair use” exception, which allows others to use a trademark to factually reference, comment on, or critique the product or service. Consider whether a viewer might mistakenly believe that your company created or is sponsoring the content. Before submitting a trademark claim, ensure that the use of your trademark in the content does not fall under fair use.
  2. Submitting a false or misleading claim of trademark infringement may result in liability. Latin Dance Events reserves the right to seek damages from any party who files a false or misleading trademark infringement notice.
  3. To address your trademark claim, it must be sufficiently substantiated. This means your notice should include the following details:
    • Your full contact information (name, mailing address, and email or phone number)
    • The specific word, symbol, etc., for which you claim trademark rights
    • The basis of your trademark rights (such as a national or community registration) and registration number, if applicable
    • The country or jurisdiction where your trademark rights are valid
    • The category of goods and/or services associated with your trademark
    • The exact location(s) within the reported course URL(s) where your trademark is used
    • A description of why you believe the content infringes on your trademark
    • If you are not the rights holder, an explanation of your relationship to the rights holder
    • A statement that reads: "I have a good faith belief that use of the trademark as described above in the manner complained of is not authorized by the trademark owner, its agent, or the law."
    • A statement that reads: "The information in this notice is accurate, and I declare, under penalty of perjury, that I am the owner or authorized to act on behalf of the owner of a trademark that is allegedly infringed."
    • A statement that reads: "I agree that Latin Dance Events may forward my complaint, including my contact information, to the affected user."
    • Your electronic signature ("/s/" followed by your name, e.g., "/s/ Jim Smith") or physical signature

Counter-Notification

If we receive a valid copyright takedown notice, we will send a copy of the notice to the instructor who posted the content, along with a notification that: (1) the content has been reported for copyright infringement, and (2) it will be removed from The Studio. If your content was removed from The Studio due to an infringement claim, and you believe this was an error or that you have permission from the content owner, you may submit a counter-notification to help us to resolve the issue and get your course(s) back online.  The most efficient way to send us a counter-notification is by submitting a Counter-Notification Ticket in the support section of your online account here. The link can be found in the original infringement notification in the support section of your account.

Submitting a false or misleading counter-notification to an infringement claim is illegal, and you may be held liable for damages as a result. Latin Dance Events reserves the right to pursue damages from any party that submits a counter-notification in violation of the law. For a counter-notification to be valid, it must be in writing and include the following information:

  • Your full name, address, and either an email address or phone number  
  • Your physical or electronic signature  
  • A statement, under penalty of perjury, affirming your good faith belief that the content was removed or disabled due to error or mistaken identification
  • A statement consenting to: (i) Latin Dance Events sharing your name and contact details with the claimant; (ii) accepting service of process for any legal action from the claimant or their representative; and (iii) submitting to the jurisdiction of the federal district court for your place of residence

Contra-Notificación

Si recibimos una notificación válida de eliminación por infracción de derechos de autor, enviaremos una copia de la notificación al instructor que publicó el contenido, junto con una notificación que indique que: (1) el contenido ha sido reportado por infracción de derechos de autor y (2) será eliminado de The Studio. Si tu contenido fue eliminado de The Studio debido a una reclamación de infracción y crees que esto fue un error o que tienes permiso del propietario del contenido, puedes presentar una contra-notificación para ayudarnos a resolver el problema y restablecer tu(s) curso(s) en línea. La forma más eficiente de enviarnos una contra-notificación es presentando un Ticket de Contra-Notificación en la sección de soporte de tu cuenta en línea aquí. El enlace también se puede encontrar en la notificación de infracción original en la sección de soporte de tu cuenta.

Enviar una contra-notificación falsa o engañosa sobre una reclamación de infracción es ilegal y podrías ser responsable de daños como resultado.
